Why shouldn't Marvel pay? They sold the film rights to Fox. Marvel just expects Fox to give them back the film rights because the Marvel Cinematic Universe is currently a success?

I don't think they did. Marvel will eventually pay them off or will shoot themselves in the foot not supporting their flagship title. Fox makes a nominal effort every few years to put out a Fantastic Four related movie so they can retain the rights. But that's their right. Marvel sold them the movie rights.
