Why shouldn't Marvel pay? They sold the film rights to Fox. Marvel just expects Fox to give them back the film rights because the Marvel Cinematic Universe is currently a success?

Marvel still owns the IP and the film rights act more like a renewable 7 year lease. As I explained, they didn't renew the rights to Daredevil by simply not making a film since it was not a success. Fox didn't consider Rise of the Surfer a success since their plans to make the third film halted. JMS was working on a script and all 4 principal actors had a 3 year picture deal. They were probably paid off for the film that didn't get made.

Let me put it another way. What incentive does Fox have to give Marvel the rights back? Marvel apparently refuses to buy the rights back.

Why should Fox give up the rights to the Fantastic Four movies?

Rumors are that when the DD rights lapsed, Marvel was going to let them keep Daredevil if they could get back some FF characters. That deal didn't happen. But it could have soured any deal with the Fantastic Four. It's extremely doubtful that Marvel will pay to get their own IP back. They may negotiate other terms. Who knows? Maybe their last failure may make them eventually work out a deal as with Sony. We know very little about this Victor von Doom project. Just because it may be in development it doesn't mean it will get greenlighted. Projects can stay in Development Hell for years.
