Can't look in the MUMB arcives, ATM, but the scope of the copyright restrictions with ROM are somewhere there, IIRC. However, as of 6 years ago Marvel could still use 'Dire Wraiths' - linked below. Not sure if the new IDW contracts https://www.comicboards.com/php/show.php?msg=indies-2016060313411225 changed that, though.

This could be wrong, but I thought I read somewhere that Dire Wraiths were created in the Marvel series itself, not before then, so that is completely separate from the ROM character and they can use them as they wish.
