That was called out by the characters as unusual, so I'm not seeing the problem.

There's room to criticize Busiek, but I don't think continuity is the right fight to pick there. For my money, Busiek handles the nuances of continuity better than any writer in the industry. He's got an encyclopedic knowledge of Marvel's canon, but almost never lets it get in the way of a good story or makes the comic feel inaccessible to new readers.
