I understand the concern, but non-consenting or not it was still a sexual encounter, which is why we're counting them for completeness sake. Also the rapes on the list thus far are not 'normal' rape in the conventional sense--they were not physically forced into the sex. Thor and Ms Marvel were both mind controlled into having sex, and the Phantom Rider drugged Mockingbird into believing she was in love with him. It was a mental manipulation rather than a physical assault. It doesn't make it any less of a violation though.
