    Actually, there is a bit of a controversy as to whether the Black Cat is a rip-off of Catwoman, but let's not get into that.

In this case, I can't buy any counter argument even if Marv Wolfman says that he didn't do it on purpose. In 1979, Catwoman was already too well-known, even beyond the scope of comicsdom, for Marvel to not acknowledge her existence.

Obviously, DC didn't sue Marvel.

I guess that the lawyers concluded that a sexy female cat burglar in a catsuit is too much of an archetype to build a case on it.

Also, I have the feeling that, contrary to what happened with the famous National Comics vs Fawcett case (1939-1951), publishers don't want anymore to engage long lawsuits.

There are only two main companies left and people know too well each other. It is no longer a competitive market but an oligopoly.
