Big difference. Joss wasn't the exec who green lighted Buffy. In addition, it's his own property.

The ethical concern likely comes from the fact that Hudlin would/could benefit outside his BET contract by using BET resources. He's on their payroll to work on BET's behalf, not his own.

That said, it's really a minor issue. Black Panther isn't an original property, after all and I doubt Hudlin would make too much from the series, even if it bumps up Panther sales. A simple waiver could fix everything, I'd bet.
