You're incorrect.

T'Challa was stripped of the herb-given Black Panther power before he faced his first challenger as King, meaning that yes he absolutely had the herb during Civil War.





No, he was specifically given the herb at the ceremony. He fought Man-Ape (I think he got the herb afterwards) and then fought Killmonger, where it was specified it was stripped off him.

It was clear in the film that the King got the herb, not the heirs. There was a whole dialogue, about when he got the herb, was then buried alive and communicated to the previous Panthers.
