They absolutely should and in fact that's exactly what I want them to do.

The Supreme Court should not be "discovering" new rights in the Constitution. Instead, the state and federal legislatures should be establishing new rights by writing laws. These laws, so long as they increase rather than diminish rights, will be unassailable from a Constitutional perspective, due to the 10th and 14th Amendments.
