Because up till now they haven't needed to.
Roe v. Wade created an environment where pro-choice legislation was superfluous. Now, finally, we find ourselves in a situation where the Supreme Court appears to be stepping away from its previous arbitrary whim, leaving a void that can only be filled by federal or state legislatures doing their jobs. We will certainly see some (maybe most or even all) blue states passing pro-choice laws, and these laws will be Constitutionally unassailable, thanks to the 10th and 14th amendments. We will see some (maybe most or even all) red states passing or at least proposing pro-life laws, but the question is, can they make them stick? Most Americans are to the right of Roe v. Wade but to the left of the Catholic Church on the abortion question. I predict, when the dust settles in about a year, the states with pro-choice laws will outnumber the states with pro-life laws, and of the states with pro-life laws, the ones with less Draconian variants will outnumber the ones that prohibit all abortions from conception regardless of extenuating circumstances. Nevertheless, there will certainly be states where any woman who accidentally gets pregnant will be heavily inconvenienced, perhaps even to the point of having to move out of the state.
As for Congress, they will dither - unless the Republicans win a filibuster-proof and veto-proof majority in the Senate this November, in which case, a very bad thing may happen, if the Republicans really mean what they say in their speeches. But I doubt this will happen, because the Democrats will now have abortion as a major talking point. I think abortion may even overshadow the economy. We'll see.
