Yeah it sounds like he is just a plot device. It will just be used as a reason why James and Oliver will end up not fighting anymore. James will just be like "my bad" and walk off into the sunset at the end of the season.

Also I think it's funny that James is like "You killed my son" and Oliver is like "That sounds like something I'd do" but then James tells him a year ago today and Oliver is like "Wait, I was out of town" So Oliver remembers trip he took better than he remembers people he's killed!

Without the evidence or testimony the case collapses and the FBI will either quit or she will keep digging around.
