Being Bought-out by another company doesn't mean that they "went out of business". DC was purchased by Warner Brothers .... does that mean DC Comics "went out of business"? Marvel Comics has been purchased by several companies/individuals over the years ... are they "out of business"? And, if Western Publishing had disappeared in 1982, how could Jim Shooter have licensed any characters from them in 1990?

The difference is that those companies stayed in business as Marvel and DC, whereas Western's properties were absorbed by the new company and used by them. Had Warner Bros. purchased DC and then re-named their comic line WB Comics, then DC would be no more. Shooter licensed the characters from the new company that owned them.
