Yep- that was out of date with the first arc of JSA almost a decade ago. Hector was reborn and became the new Dr Fate in that first arc. Lyta came back into the picture a few years later and stayed largely in the background with no hint of what happened between the events of Sandman and "now" until she and Hector "died" again during the Spectre's war on magic. There was a panel implying Daniel had taken them into the Dreaming rather than let them die but either way they are gone for now from Justice Society reality.
