Stark isn't elected. In fact, he used morally questionable means to attain power.
Our democracy also protects the rights of the minority. As it stands, registration drafts every superhuman, regardless of whether they want to be a hero or not.
(And argue intent all you want, but don't say it's unrealistic that the government wouldn't try to grab every superhuman it could).
