Just look at a number of pre-Civil War stories. Heroes were considered accountable under the old system and would be hunted by the police if they killed or hurt people (this happened to Spider-Man quite a few times, e.g. when he was suspected to have killed Gwen Stacy, usually until he proved his innocence and caught the real perp).

Yeah, but often some teams of heroes refused to turn in villains that they thought had reformed, and the other teams of heroes did nothing about that. Rogue is the classic example. Xavier refused to turn her into the authorities because he thought Rogue had changed and the Avengers did nothing about that.(Note that he didn't ask Ali and Carol, who were actually the injured parties.)Of course the new system isn't much better. Kill a million people or try to start a nuclear war and you wind up on the Avengers,no questions asked.
