Whether or not it's the truth is irrelevant. Peter deciding not to change to Spidey just out of a desire to spite JJJ? On which planet is that not wildly out of character for Peter?

On our planet. The Amazing Spider-Man run is peppered with times that Peter has quit being Spidey for various reasons including having had enough of being labelled the bad guy no matter what he did. Very much in character. He was actually trying to stop the mugger and believed that he could until something (Aunt May) came out of left field... which is also a regular part of the Spidey mythos.
