Probably. NYC really should institute a Superhero escort for superVillains to prison holding facilities. Or revisit Code Blue and assign them the task in all cases to give that character concept some facetime. Or at least repeat how tight budgets are to believably explain how en route escapes are so commonplace to allow for adventures/clashes with said bad guy du jour.
Even before Logan's status as an Avenger, the X-Men had SHIELD on speed-dial when they were otherwise known as outlaws. They're far from outlaws these days, so...

It seemed that ever since the shocker that they kept Sabretooth locked up in the X-basement the practice of selectively imprisoning X-villains, in a "cell" or somesuch, by the X-men themselves has become a (debatable) way of life for them.
Before that, even. Juggernaut was Basement Boy long, long ago (X-Men v1 #32-33).

I definitely don't agree. Scott really hasn't spent any time trying to make up for anything. In his favour, at least, he's no longer claiming to be proud of what he did under Phoenix's influence and that he'd do it again. Scott still hasn't really changed tactics from his X-Force thing, which was why Kurt quit the team before being killed. And Kurt still believes in Logan's way of choice over Scott's dictatorship.
