It's still an appropriate cover, considering he's the villain. I didn't see the suggestion that Beast is responsible for the haywire powers.

Nothing really inconsistent. Cops always have discretion. Bigger fish to fry, and all that. Beast is afforded some degree of trust, and there's no reason he shouldn't be.
